The Home of Pilates app stores:
- name, email address and photo url from your google/apple account.
- your answers to the survey questions.
- any feedback you send.
Home of Pilates does not and will not share any of this information with any third parties.
All the above data is stored on servers owned by Google. It is encrypted when it is at rest and encrypted in transit.
If you delete your Home of Pilates account, the details obtained from your google/apple account will be removed from the app, so no data can be linked to you.
WAIVER OF LIABILITY
I have volunteered to participate in a program of progressive physical activity which may include but is not limited to: weight and/or resistance training, cardiovascular training, flexibility, and balance under the direction of Charlie Pank (instructor) and Home Of Pilates (organization).
To the best of my knowledge, I am in good physical condition and I have no disease, physical limitations, health concerns, or injury, that would be aggravated or would be the cause of any injury sustained, before, during or as a result of my participation in activities related either directly and/or indirectly to this Program.
I recognize that exercise might be difficult and strenuous and that there could be dangers inherent in exercise for some individuals. I acknowledge that the possibility of certain unusual physical changes during exercise does exist. I recognize that an examination by a physician should be obtained prior to involvement in any exercise program. If I have chosen not to obtain a physician’s permission prior to participation, I hereby agree that I am doing so at my own risk and I assume the risks associated with any and all activities and/or exercises in which I participate.
I am participating in the Studio’s Programs voluntarily and with the full understanding of any risks and I release, waive, and discharge Charlie Pank and Home Of Pilates from any and all liability, claims, and causes of action directly or indirectly arising out of or related to any loss, or injury that may be sustained by me, while partcipating in any activity under the guidance of my instructor or the organization.
End-User License Agreement (EULA) for Home Of Pilates
This End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Home Of Pilates Limited (“Company”) for the use of the Home Of Pilates mobile application (“App”) and any related services or content provided by the Company.
- Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the App. - License Grant
The Company grants you a non-exclusive, non-transferable, revocable license to use the App on your iOS or Android device in accordance with this EULA. - Intellectual Property
The App and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by the Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. - Restrictions
You agree not to:
a. Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the App;
b. Reverse engineer, decompile, or disassemble the App;
c. Use the App for any commercial purpose or for the benefit of any third party. - Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis. The Company makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included in the App. - Limitation of Liability
In no event shall the Company be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of the App. - Waiver of Liability
You acknowledge that you have voluntarily chosen to participate in the Pilates program provided through the App and that there are inherent risks associated with any physical activity. By using the App, you agree to release, waive, and discharge the Company and its instructors from any and all liability, claims, and causes of action directly or indirectly arising out of or related to any loss or injury that may be sustained by you while participating in any activity under the guidance of the Company or its instructors. - Governing Law
This EULA shall be governed by and construed in accordance with the laws of New Zealand, without giving effect to any principles of conflicts of law. - Termination
The Company may terminate this EULA at any time without notice if you fail to comply with any term or condition of this EULA. Upon termination, you must cease all use of the App and destroy all copies of the App in your possession. - Amendments
The Company reserves the right to modify this EULA at any time. Your continued use of the App following any changes to this EULA constitutes your acceptance of the revised EULA.
By using the Home Of Pilates App, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
